These Terms of Service ("Terms") govern your use of our platform and services. Please read these terms carefully before using our services.

We provide a platform for professional field data collection, management, and analysis. Our services include:

  • Collection of geodata and field data via mobile and web applications
  • Storage and organization of project data
  • Data analysis and visualization tools
  • Export and integration capabilities
  • Team collaboration features

We reserve the right to add, modify, or discontinue features at any time, with advance notice for significant changes.

3. Account Registration

To use our services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account information up to date
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

4. Subscription and Payment

4.1 Subscription Plans

We offer various subscription plans, including free and paid options. The features and limitations of each plan are described on our pricing page.

4.2 Payment Terms

  • Paid subscriptions are billed in advance (monthly or annually)
  • All prices are in Euros and may be subject to taxes depending on your location
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You authorize us to charge your payment method on file for recurring payments

4.3 Price Changes

We may change our prices with 30 days advance notice. Price changes will take effect at your next billing period. Continued use after a price change constitutes acceptance of the new price.

4.4 Refunds

Paid subscriptions are generally non-refundable. Upon cancellation, you retain access until the end of the current billing period. In exceptional circumstances, we may provide prorated refunds at our discretion.

5. User Content and Data

5.1 Ownership

You retain all rights to the content you upload or create through our services. We do not claim ownership of your data.

5.2 License Grant

You grant us a limited, non-exclusive license to store, process, and display your content as necessary to provide our services. This license terminates when you delete your content or close your account.

5.3 Responsibility

You are solely responsible for your content and warrant that you have all necessary rights to upload and use it. You must not upload content that violates laws or infringes on third-party rights.

5.4 Data Backup

While we take reasonable measures to back up data, you are responsible for maintaining your own backups of important data. We are not liable for data loss.

6. Acceptable Use

You agree not to use our services for:

  • Illegal activities or to promote illegal activities
  • Infringing on intellectual property rights
  • Distributing malware, viruses, or harmful code
  • Unauthorized access to systems or other users' data
  • Placing excessive load on our infrastructure
  • Automated scraping or data collection without permission
  • Circumventing security measures or access restrictions
  • Reselling or sublicensing our services without permission

7. Intellectual Property

Our platform, including all software, designs, logos, text, and other materials, is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use our services in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works of our software.

8. Privacy

Your use of our services is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal data.

9. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties regarding availability, reliability, or accuracy of the services
  • Warranties that the services will be uninterrupted, secure, or error-free

10. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages exceeding the amount you paid us in the past 12 months

These limitations apply regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless us, our affiliates, directors, employees, and agents from any claims, losses, damages, liabilities, and costs (including reasonable attorneys' fees) arising from your use of the services, your content, your violation of these Terms, or your violation of any third-party rights.

12. Term and Termination

12.1 Term

These Terms become effective when you register and remain in effect until terminated.

12.2 Termination by You

You may terminate your account at any time through your account settings or by contacting our support. Upon termination, your subscription will end at the end of the current billing period.

12.3 Termination by Us

We may suspend or terminate your access to the services if you violate these Terms, engage in illegal activity, or fail to pay your account fees. For serious violations, we may terminate your account immediately without notice.

12.4 Effect of Termination

Upon termination, you will lose access to the services and your data. We may delete your data after a grace period of 30 days. Provisions that by their nature should survive termination (such as limitation of liability and indemnification) will remain in effect.

13. Changes to Terms

We may modify these Terms at any time. For material changes, we will notify you at least 30 days in advance by email or through a notice on the platform. Your continued use of the services after the changes take effect constitutes acceptance of the modified terms. If you do not agree to the modified terms, you must stop using the services.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

15. Dispute Resolution

In case of a dispute, we will first attempt to reach an amicable resolution. The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/. Our email address can be found in the Impressum. We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that most closely reflects the economic purpose of the invalid provision.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies published on the platform, constitute the entire agreement between you and us regarding the use of our services and supersede all prior agreements.
